Your purchase or accessibility of a print, original artwork, or other products from Sugar B Designs or Carrie Beth Taylor is a purchase or handling of an authorized physical copy (or copies) of artwork, not of copyright in that product or of any rights protected by copyright, including but not limited to the right to reproduce, resell or publish the art or anything similar or resembling such artwork. All rights in the artwork/product are reserved by Carrie Beth Taylor, and any use beyond the display and personal enjoyment of the items(s) you purchase requires the prior written approval of Carrie Beth Taylor, which may withhold its permission or limit any license granting permission for further use in its sole and unfettered discretion.

This reservation of rights applies equally to all artwork and other materials viewable on the website and/or offered for sale by Carrie Beth Taylor/Sugar B Designs regardless of format.

This means: You may not share or use any artwork or form of artwork (printed, embroidered, photographed or other form) from Sugar B Designs online and/or Carrie Beth Taylor directly, regardless of how they are viewed or obtained, on your personal or business website, or for any commercial or noncommercial use, without first securing approval from Carrie Beth Taylor. Such prohibited uses include—but are not limited to—use of an image as part of another website’s design, or as an avatar, icon, badge, clothing, banners, or otherwise in connection with an account on a social media platform (for example, Instagram, Pinterest, Tumblr, Twitter, Facebook); on T-shirts, mugs, or other objects, either alone or in connection with other text or images; in print or electronic publications in visual or audiovisual compositions or productions; or as the basis for any product or service. Altering the artwork/item(s) with respect to size, color, composition, or other qualities, or the addition of other elements to a photograph, does not exempt you from these restrictions, and is not permitted without prior written approval.

Sugar B Designs work created via commission or for general use are protected from misappropriation, misuse and unauthorized use by copyright law and international copyright treaties, as well as other laws and treaties that uphold intellectual property rights. Sugar B Designs retains the right to use any design or illustration that has been commissioned to promote my work and use for resale. Permission must be obtained in advance for any use of my work. Should you wish to use my design or illustrations and/ or files for commercial purposes, Sugar B Designs must receive an agreed upon fee before utilization. Any design used in any way must contain a credit indicating that Carrie Beth Taylor of Sugar B Designs is the creator. Anyone granted permission to use any of my work is subject to these policies.

As copyright owner, Sugar B Designs has a number of exclusive rights under the Copyright Act 1968 (Cth). These exclusive rights include the right to reproduce the Work, and to publish and communicate the Work to the public (including by way of sale, broadcast or putting the Work online). It is an infringement of copyright to do any of the acts comprised in the copyright in relation to the whole or a substantial part of the Work, or duplicate a direct liking of the work, or to authorize such an act, without the permission or license of the copyright owner.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Tennessee without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these Terms and Conditions, including any violation by you of these Terms and Conditions, shall be filed only in the state of federal courts located in Wilson County and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating such action. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions.
